in short... anyone who receive the letter SHOULD not pay and lawyers should know that this case is full of loopholes and this is one of them.
The above extract sets out the offence committed when one infringes upon the copyright of a copyright holder. For the alleged offender to be liable to penalties (fine or imprisonment), the alleged offender must first be charged and found guilty of the offence. Odex has no capacity to charge anyone of an offence in criminal law, nor to find the alleged offender guilty of an offence.
Odex only has the right to initiate a civil action against downloaders for losses suffered as a result of the downloaders action.

It is an offence to commit piracy. However, it is up to the proper authorities to decide whether to charge a person for a criminal offence. Odex's cause of action, if any, lies in another section of the Copyright Act:
OIC... I made the same assumption in a few posts back.... but if you see the link form Wiki, their letter only demanded "compansation" or they will take legal actions, they did not do anything "wrong" per se.
Ultimately, there are many factors to consider and without knowing what evidence Odex possess to support its claim, we cannot assume it does not have a strong case.

Under Singapore's law, copying is permitted for educational and news reporting purposes (as well as other specified ones). But only an unimaginative reading of the law would conclude anime downloading is clearly illegal.
