You do not have to be a professional photographer to demand royalty fees. Look at the stock photography sites that are out there. They do not demand that you have to be a pro. It's a matter of respecting the rights over intellectual property, which are unfortunately disregarded often in these competitions.

yes of cos..dont need to be pro to be stock.. btw, how to sell your photos to the stock photo sites? how much are we able to make per photo if we are not "famous" yet? ;-)
 

Well I don't think so for two reasons:

1. It is doubtful that model releases are not required under Singapore Laws.

2. Even if model releases are required, I'm not sure if "publicity" and "communications" falls within the concept of commercial usage. (will need to check out the specific US legislation on this - however please note that this is US laws, not Singapore).

Nevertheless, if you think its required, then accept the clause with that in mind. Its really up to the contestant to weigh the risks involved and decide accordingly.

end of the day, these terms might be just "cut and paste" from another contest..
 

pardon me... but why does this always happen? when someone post a competition and the thread will end up talking about the copyright issues? You want to take part then just go ahead, if you feel that the terms not right, than forget it...

i'm jus stating the fact. tat's all. if i have a picture that I felt its good enough... with that prize money, hey! why wait? send lah!
 

I don't see anything wrong with discussing about the terms and conditions of the contest - after all it is an integral part of the contest.

sometimes if you read the T&C, you will see that you are giving away the ownership of your image when you join the contest.

that means that the image will belong to the organizer once you submit your "good shot".
 

Wow... STB is also jumping on the bandwagon for free images. Many must be happy that this is another competition their peers wouldn't be taking part in and challenging them for the top prize.

Sigh going by the trend, it doesn't look like T&Cs will ever change for the photographer huh?

you sell your photos by predicting what the buyers need. It's not a famous issue, if the buyer sees and likes your picture then he'll buy it. Of 'cos if you're good at predicting and producing good stock photos, then that would be your equalivant of "famous".
 

T&C is normally made to protect and to the advantage to the organiser and not the photographer. But what to do ?? :dunno:
If you don't agree to it, then don't take part, as simple as that.

But for $10,000 prize money, I think all should submit, whether you are good or bad. Just go and think a bit, snap something and submit. It is not tedious at all and you have got nothing to lose. You will never know yours is a winning photo.

yeh, agree with OB1.... y always the same old thing being discussed over and over again.

if u think your shots are that good and think not worth giving up to participate for the $10K, then keep them in the cupboard or your hard disk and wait for people to buy loh. If your shots are really that good, then I think u should have confident to win the $10K anyway.

everyone has the thought of photo rights here and there, but what is it to u when its always in the drawer or your harddisk? Just send in lah, who knows like what OB1 says, u might win the $10K leh..;p

if you think the T&C does'nt meet your requirements, then dont participate loh, whats the point of discussing same topic again and again leh? if not happy then organise one competition which u think the T&C is very righteous one loh...:bsmilie:
 

There isn't really anything wrong with discussing what seems to be the same issue again and again. Each time a competition arises, the people in the know are trying to be helpful by pointing out the terms and conditions and their possible implications. This would help those who are not in the know (ie newbies, who are born every minute, or even oldbies who may not realise the legal implications).

Greater awareness would also mean that the participants, before joining, know what they are getting themselves into, and then, make an informed decision whether to join or not.

Of course, we can say, like you join, don't like you don't join. But why can't we also say, don't like and lets talk about it. Thats the very nature of a forums - to discuss

If anything, this creates greater awareness on the topic rather than just hushing it away and saying "buyer beware, you want you buy, you dont want you don't buy". Such a mentality will only result in the greater ability by the organisers or whoever to set T&Cs which are increasingly weighted against the participants.

As this competitions thing start to gain more awareness, perhaps then some progress can be made to try to make the terms more equitable - in fact, who knows, the organiers may go "hmm how come last 5 years eveyrone join, then recently like less and less pple join, and now I even have to give the first prize to this crappy shot...".

Of course, this is not certain, but what can be certain is, if there is no discussion or awareness, there will be further ingrained in the industry, these set of supposedly standard terms. By then, it will really be take it or leave it (see insurance T&Cs, Banks and credit card T&Cs - they are so weighted against hte consumer simply becuase their industry might has made them able to do it - and also a lot of consumers don't read these terms and only know about them when there's a problem)

Agree with you with the awareness of the T&C.
So what do u suggest to resolve this issue or to improve it? :dunno:
 

Well discussing and raising awareness like what is happening now is a good start.

Did anyone who is not happy with the T&C write to the organization and inform them about the rights thingy???? WIll be more effective i think....:think:

if everyone just keep quiet and just join then it will never change
but only get worse.

so typically singaporean, kwai kwai keep quiet
lan lan just submit to the powers that be.

BTW I also singaporean.
 

BTW this is worse

it should not be called a compitition, instead call it a charity drive.
