Oh please, if being a “Rafflesian” meant anything to him at all, he would not have done what he did in the first place.
Under the court of law, he had the intention to deceive, that what your friend posted was his own original work by his actions of fabricating the origin of how he created his work. Although he has not used the work for commercial purposes, the fact that he passed off a professional photographer’s work as his own is a serious offence. If the photographer still owns the copyright (they usually do to a certain extent) or has shared rights to the photograph with Airliners.net, both parties will be able to sue you for damages.
Your friend's persistence in insisting that the images were shot by him when members in the forum doubted the origins of the photographs will only make matter worse. CS will be asked to assist in investigations should this amount to a legal battle. All his posting logs will be used as evidence for his defiance to admit to the offence and his intention to deceive.
We have to start respecting other people’s work. It is one thing to keep a copy of someone else’s image saved in your computer if it inspires you or just for appreciations sake, and a totally different matter to pass it off as your own work. What good will it do you when people are praising that photograph that you posted? It’s not you that they are praising, but the photographer that shot it.
From his stated settings, I wonder if he is trying to take everyone in the forum for a fool. Pushing his luck with his 300mm/f2.8 stunt or he seriously lacks photography knowledge to pull-off a stunt like this. He is way out of his league here. The least he could have said was 28mm/f5.6, 1/15s. Daring settings for 1/15s, but I’d bite.
I’m sorry, but where you attend/attended school and anything else for that matter does not correct or lighten the severity of the offence you committed.
This is not a “Sorry, my bad” kind of situation we have here gentlemen. In the court of law, you will be punished accordingly. Just pray that the “Bailey” in the photographs credit line does not belong to “David Bailey”.
