Photo "stolen" by newspaper reporter

yes...you should press on. Even if you are not looking for monetary gains, I personally feel the least you should ask for are:

(1) a public clarification that the pic is yours &
(2) have the news reporter call you personally to apologize.

This would be the least I would expect if such things happen to me.

i decided to email to the editor and inform him that it is wrong for the press to do such thing.. i dont care if there is moneytary gains .. and i dont even care if use the pic without giving me the cerdits and leaving it nameless but i dont not appriciate his reporter to claim it his own ... so i guess i do that ... like 2100 say leeches come in many forms but i would like to let this ppl know is it wrong and get a reply .. especially from the press ..

so what u think? should i be harder on them ?

I think duhville should take it to the max. learn to use the power of the media to your advantage. this is the purpose of its existence anyway. think about it. :)
 

Yes, I think you can feel assured that you have got a community here behind you. Don't worry, just make sure that on their part they credit you properly and that they handle the matter appropriately. They/he made a mistake, they should be apologetic at the very least. If they are agressive or not cooperative, take your story and complaints to Today paper, and be heard. You are not merely protecting yourself, you are also ensuring the rest of us here taking pictures do not have our picture credits leached by an errant reporter and paper.
As you said, to you, as an amateur photographer, not making a living out of this, it means a lot to have your photo published. You should back your own beliefs with the appropriate follow-up action(s).

You've done the right thing. I guess it feels like ya work has been stolen by another and all credits go to him. Let us know what's the outcome of the email and we shall plan the next move... :devil:

Mr.Guntor Sadali

I am writing because of some unfortunate mistake(i hope) from one of your "penulis sambilan" Mr Syamzari Mohd Shah in regards to the photo used on the article "BERBAKAT DENDANG SECARA BERHARMONI RENTAK ACAPPELLA" that was printed on the 27th July 2004.

I feel disappointed that the article stated - loosely translated - "story and photos by Syamzari Mohd Shah". I cannot deny that the good story is by him but i have to claim the right for one of the photo used in the article -photo of the group Juz'B- as it was taken by me.

Thou i gave permission to reproduce the photo to the group that was interviewed by Mr Syamzari, i feel that it is very wrong for the reporter to claim it as his own as me being the owner of the photo have not sign any release clause from Berita Harian and i believe it is the practice of the press to give credit or even pay the person or the organization that took the photo that they reproduce. Even if he didnt know at first he should make a small effort to find out "who is the photographer?" as it would reflect well on the professionalism of Berita Harian.

Somehow i would like to believe this was a mistake by Mr Syamzari and i certainly do not want to make a big "hoo haa" as i am friends with one of the member of the Acapella group.

But tell me how would you feel if you are a budding amature photographer and your childhood dream has always to be a press photographer and you see your photo in the papers? it is a rush of ultimate joy, something that make me smile even thru the insane pain of childbirth, something that a photographer especially an amature like me would frame up and hang it on my living room wall, my pride and joy. If he did not give any credits it would already be a big dissapointment but to claim it as his own , i felt raped.

So with this i end this mail and hope you would set some wheels in motion about this matter.

Do take a look at the link as i brought this up in a local photographer forum and there you can see their opinions. Many local photographers wanted me to do more as to prevent things like this from happening to the community but i feel this is just a big mistake and lack of initiative from the reporter, so all i do is write you this mail.

correct me if I'm wrong, but was it one of the Berita Harian photogs who got into trouble when some undesirable (well, desirable to some) parts of a local footballer was accidentally photographed? :bigeyes:

Think this happened sometime back -- last year?

Hi Duhville, i think you have done it right.. cant image the work u had done and credit to someone else.. is not fair :nono: . They should feel ashamed of been a professionalism reporter work that need public to complete their task and without paying back to the owner.. :nono:

Yes it happened before.

At least one incident which I can remember:

When the Nicoll HW collapsed, some witnesses claimed that thay saw fire coming out from the hole. The 'relevant parties' denied.

Then a newspaper had a pic (taken with hp camera) published, showing the fire over the collapsed site. I believe it is THE one-and-only pic that captured the fire.

Credit was given, something like "contributed by reader xxx".

Thereafter, the same pic were gradually published on other papers. Credits were given too.
 

i would like to ask.. if you took a photo..
and someone saw it and did a similar photo and got some credit...

then do you own copyright?? or there is nothing u can do to tat person..
 

copyright belongs to the person who took the photo. however, if you did some unique arrangement which confers rights on you, and that person takes a photo of it, there could be possibly some liability.

yes, you should pursue redress for this injustice.
