Regarding the loose copyright clauses, you have a point when you say that none of us can be certain of the intention of the corporation. It could be a cover-all clause to mininise any legal complications, it could be a exploitation of less discerning photographers, it could be somewhere in between.

None of us can claim to know for sure, but using your same argument, I suppose you can't claim to know for certain either.

I don't see where it wrong to highlight suspect clauses and create awareness. And if people are still willing to join the competitions after that, then they do so with an informed choice.

Well bro, he may know if he works in Maybank or related to this competition and is very uncomfortable with the T&Cs or maybe something else. There is no right or wrong answers in this thread, i would suggest just do what individuals want to do, willing = join, unwilling = don't join. Ahbian, if you look carefully at Maybank's T's and c's, they do not require you to give up copyright. Just to give them the right to reproduce.

Which is actually what Arizona highways has below as well, ie AH can reproduce submissions in any promotional materials without any compensation beyond photographer credit.

So is there any substantive difference between what Canonixus thinks is a favourable set of t+c vs what Maybank does?

Maybank Group reserves the right to publish or display all entries, with or without the name of the author, for purposes including but not limited to advertising, publicity and exhibition, without payment of any fees to any party or the need for written consent from any party.
The Arizona Highways 2011 Online Photo Contest is open to amateur and professional photographers, except employees of Arizona Highways magazine, the Arizona Department of Transportation and members of their immediate families. Any images not made in the state of Arizona will be disqualified. By submitting images to the contest, participants grant Arizona Highways magazine the right to publish their images in Arizona Highways magazine and on its website and in any promotional materials (i.e. press releases, future photography contest announcements, social medial efforts, etc.) for no other consideration beyond photographer credit. Photographers retain copyrights to their submitted photographs. First-, second- and third-place winners will be announced in the September 2011 issue of Arizona Highways, as well as on our website. Only the winners will be notified. Incomplete submissions will be disqualified.

do you understand what "including , but not limited to" means? let me explain it to you....

when i say that my purposes include, but are not limited to A, B and C. it means that i can introduce D, E, F, G, all the way to Z, and it is covered. in short, it covers EVERYTHING. use to print on toilet paper also can hor. just so you know.

that said, that line in the arizona contest should be highlighted also.

like kit says, don't think you respect your photos if you are willing to let people wipe their arse with it. :bsmilie:

If we find that, even in one of the most respected landscape photo magazines, the rules of the contest require that you give them the right of reproduction in all substantive media that they own (ie web, print, social media, etc), then why would you expect any corporate, whose main business is not selling photos, and whose lawyers are used to being high-handed (witness the strong t's and c's in any loan agreement), be any lesser from the t+c's of any respected photo magazines?

Yet, unlike photo magazines, who depend on photos for their business, Maybank does not. So why would you think Maybank needs to run a contest to screw photographers? Shouldn't the prime suspect be those who need photos for their business?

please, "promotional material" is very different from "substantive media they own".

having the potential to screw, is very different from running a contest to screw. what we're talking about is the former.

i might wish to highlight to people passing by a mrt station with a man holding a knife standing in front, that he has a knife and has the potential to stab someone with it. that's very different from him having actually stabbed someone with it.

you might as well say that when i say that all men have penises, thus they have the ability to reproduce. that doesn't mean that i'm saying that all men need to reproduce, or WILL reproduce.

so get your story right, instead of throwing strawman arguments around repeatedly despite people telling you that you are being absolutely ridiculous.

Hmm... so I would go out on a limb and surmise that you do agree that the T&C of the contest gives the organiser legal right of taking advantage of photographers' submission?

However you don't believe that it is the intention of the organisers to invoke that right.


Anyway, lets all keep to a civil discussion and chill. If nothing, its the holiday seasons. :)
