Hobbes00 aka David-Police Case on the way

Hi everyone, thanks for all those who have contributed to this attention-seeking thread.
I will not be trying to justify myself as it will not prove anything.
Here are afew points I would like to state...

In all productions I take up, I will always complete on time stated in the confirmation E-mail I sent out. It is the best way to protect myself - and my family (if you are a like alex)

**************************************************

I explained to Alex that completing this fully editted video will take quite a long time. Thus I did not put a date as I would not like to disappoint anyone - He agreed to it when he confirm that I was taking the job.

Trying to be as professional as possible, let me clearly state that Alex have decided to pull out of the contract. Editting is STILL underway indeed.

So when a client comes to you and force you to cancel the contract and forces you to conform to HIS new contract, what would you do?

He threaten me many times to post stuff in this forum and get the police involved.
Please note, the "I call police" came in LONG time ago before we talk about disolving the contract and returning the raw footages to him.

He is just showing you one side of the coin.

I intend to take his offer to be threated like an immature boy and return him the raw footage and the $200.

**************************************************

Now let me explain afew extra stuff that poped out of Alex's starter post.

1) MoonLighting
- What does this have to do with this contract to begin with - UNLESS it is a personal attack?? Is that what this thread is really all about??

2) I started making videos when I was sec1 when I met sam. Thats right.

3) Regarding the link Gryphon posted about, it shows one side of a coin. I will not talk about the other side as this isn't a courtroom. Typical singaporean..

4) Regarding the need to learn to have a better attitute and communication skills and the need to stop pissing my clients off, here is what I have to add....
- I have done to date, 74 Productions - 70 of them ended with a wide grin on the client's face. I guess I have to try much harder.

5) I really appreicate all of you guys who have talk about my work in such a nice way - but to be honest, my work isnt that good; theres so much more to learn.

***************************************************
To end this, with over 450 hits on this thread alone within 12 hours.

I would like to gladly wish everyone an awesome chinese new year(or holiday)

I am STILL doing what I do - video productions. (With a team of video-producers and photographers)

Regards,
David Liu
My number is stated above :)

*I do not intend to reply to this thread anymore. As it may spark into an endless debate.
I URGE THOSE WHO HAVE ANYTHING TO CLARIFY TO PRIVATE MESSAGE ME.
What I have said is from my heart, without the mask of professionalism.
It may sound crude, but I realise that many of my clients I work with prefer guys who are frank and fresh.*

Are you sure we have privacy laws here in Singapore?

And you are using the word "disposition" in the wrong context. It sure sounds like "deposition", which is usually used in a legal context to mean giving testimony under oath, but neither are correct in this matter. I notice you are trying to use big words, and legal words, but doesn't seem so accurate to me.

I mean....breach of privacy? "client-operator confidentiality"? "Lower Courts"?

Hi Alex,
Lastly, you have also displayed his address and phone number rather prominently on this site – That could quintessentially be interpreted as a breach of privacy and client-operator confidentiality. You could get yourself in a hot spot there too – I'm half wondering David is not filing a suit with the Lower Courts over such dispositions.

Could you point us to which law definitively states that accepting payment makes one an "employee"?

I highly doubt that there is such a law. If anything, this situation would be that of an indepedent contractor and not an employee.

Regardless of the amount paid, the law does state that when 1 party willingly accepts payment from another party, he will be deemed as an employee and is automatically placed under the understanding that the product "in this case the Raw footage video" Is a property of the employer. And the employer has full rights in claiming the footage. Should the employee refuse to return the footage, this can be looked upon as theft and breach of contract as well, depending on which area you are looking at it from.

Song leh, first we have two people fighting, then now we have a lawyer wannabe that cannot practise law and come online trying to be a wannabe-lawyer. :bsmilie:

If like to do law so much, go be a lawyer lah, why be a runner and hide behind a screen trying to argue so much when it doesn't even involve him. :bsmilie:

SONG leh!!

Hello everyone ,

this is interesting but unneccesary .. and i think the victim broke more laws than the suspect.. lol ... how comical .. in an attempt to seek justice .. Anyway have a great day ! Gong Xi Fa Cai ...

Actually, his jargon is accurate. He just has a propensity for verbosity XO

i believe so..... in the forum in general there are some who are banned would just signup for another account....

i just coincidentally perused the forums. and im not really fond of posting. but i thought id give my 2cents worth on this issue.

firstly. there is no, unambiguously no desideratum, to blow up such a diminutive & trivial episode. the 2 parties should endeavor, dissect & resolve this issue amicably. i would not abnegate that hobbes wasnt in the wrong at all. but again, as stated, there was no contract signed and acknowledged, no verbal agreements assumed, nor any evidence other than emails (which obviously didnt have any evidence in your favour). unless your a professional yourself, please do not undermine the herculean obligation and work that other people have to strain, having to juggle between both NS and this job assignment as well. im pretty much sure he isnt doing it for the moolah; after all, 550$ is relatively nominal and slashed for an assignment of this magnitude. please, im sure people have their apologia and vindications. just like you have your deadlines, he probably isnt just going to be lackadaisical and do nothing.

secondly, u just infringed his privacy by stating his full name, details and address. i think that is absolutely disrespecting him. please, do not overstep your boundaries. personal contacts are supposed to be confidential, and such an event is blatantly a breach of trust.

thirdly, isit worth it. to get a young guy with such a future, to what. get fined or go to jail? because your pissed with it. i mean errors happen all the time, at work, at home, at school. forgive and forget. as he has aforementionally stated, hes not a professional, so why take it too hard, you knew your risks, in fact you said you calculated them. dont you think you have a part to play? cheap things are never good. why do you think you have to pay people with experience so much more. because they have gone thru all the amateur stages before already. okay sounds rhetoric. to err is human, to forgive divine.

although i cannot really vouch for hobbes00, a friend of mine had his wedding done by him before. he probably'd be able to vouch. he didnt seem to have any qualms or complaints about it after all. so chills. solve this amicably. i envisage that there is no point in wasting lawyer fees just to take him to court, its not worth it. not for your image and neither for his reputation. and i suggest, with all due respect, to remove his address, and contact number immediately. its really overboard. continue like this, and people would think ur tinged with schdenfreude and malice to see others suffer such psychological torment. ridiculous. defamation will bring you no where.

so the lesson here is

if the job is important and there is a deadline to be met....
get a pro to do it :)

no point trying to save money that isn't yours

just like to say,

try to settle this amicably amongst yourselves, what's the pt of showcasing this in CS?

so that he cannot sleep at nite? or that, no one will engage his services in future?

when there is too much risk involved, why save the $$?

Jokes.
Who are the clones?

why so defensive?
so many new members with low post count suddenly coming in saying the same things using same kind of language.. reminds me of edmw clone wars

Imagine a service provider suddenly change the contract terms and force the client to conform to it.. - That is wrong.

How about now, the client change the contract terms forcing the service provider to conform to it - Now this is whats i'm being slammed for.

I have not been inefficient, complaisant, acted in an immature or unethical manner.

Re Direwuff. Check their IPs, E-mail, website and then reconsider what you said.

Threadstater created a new userID just for posting this complain??? Hmm.....

sorry, the 'i' in my above post should be 'no';)

This thread is starting to read like a mystery novel.

I wonder how come it hasn't been locked by the mods yet, since it's so OT from the sub-forum already.
