what happen if e-quote is wrong?

What happen if CP or MScolor gives u an wrong figure equote (much lower price)? Will they honour their quote when u go to their shop to buy the stuff at the e-quoted price? Do they have the right to change the price on the spot? In CP equote, it says the quote is valid for 2 weeks or while stock last.

I guess if they really give a wrong (lower) equote, they might just say 'no stock'. :D

But for me, i don't think they are gonna give it. And i won't pursue it. Its human error.

Nope, they wouldn't and they are not liable to. Equotes (or advertisement of prices for that matter) constitutes a mere invitation to treat and not legally binding contracts. A contract is deemed to be formed if there is an exchange of consideration, among other possibilities.
 

ads are ITTs, but quotes may be a different matter altogether. It may be construed as an offer depending on the intention of the parties. the fact that the equote states that its valid for 1 week suggests that the maker of the equote has held himself to be bound by the terms in the equote. without saying too much (and there are other evidence of this) lest i tip Cathay off :p all i can say is, there is at least an even chance to argue that it is an offer made by Cathay who intends to be bound by it.

well until a dispute arises, all this is academic :)
 

Moral of the story:
I don't think the gain from a erroneous equote can be great enough to justify the potential legal fees involved. ;p
 

I've never used an equote to buy stuff from Cathay, but I wonder how they verify the authenticity of it. I mean, it's so easy to edit the email and print out..... and if your edited version is not way way out, they might not even detect. :devil:

yah thought of that before too.... maybe at the end of everyday they will tally the printed equote which they collect from us with the original quote tt they sent out? Then blacklist tt person if he cheats....

but doubt they have so much time to do tt... maybe random checks...

hmmm regarding whether Equotes are viewed as ITT or offers... I think it seems more like an offer to me... but if it's so obviously a mistake, dont think we shld take advantage of it.
 

I know equotes from MSColor has a tracking number. And when you present the equote to them, they will check the master price list and do some calculations. I think they might have a fixed markup percentage. No sure about CP though...

Not really, I copied the equoted price and pasted to word and print..They also accept..
 

Have you guys thought about the fact that they may actually know what the equote prices should be ? Or have a reference somewhere for the more esoteric products ? Therefore if you muck around with the equote, they will probably know ... and you'll be laughed out of the store :bsmilie:
 

It may be related to poster's question:

I have a friend who asked for a quote at Cathay Photo for an Epson printer and was quoted a price. Went to the shop to pay for it and even got the receipt and was asked to collect it later. When he went back to collect it, they told him that they forgot to add the 4% GST and that he had to pay that first before he could receive the printer........this friend of mine is an old customer of Cathay, had always bought many expensive stuff there, and yet for this small mistake they didn't bulge............at the end he just paid the extra 4%.

At MS Color, the equote price will be 30% cheaper than the retail price. :D

Wah.... so much cheaper meh? Haha.... For me I think I should patrnise MScolour more tha CP cos MScolour is downstairs only...

Yups. For most of the items that I equote before, it seems that this is the case.
 

AP did mis-equote me before. item is $15 lesser and they did honour the deal and sell to me. i left the shop with a BIG smile :D
 

GOod for you. I got misqouted once also. The difference is only 10 dollars and they will not honor it. Too bad, I walked out of the shop and bought the samething somewhere else even though it cost me a few dollars more. It's not the money. It's how you honor your biz.
