Newspaper used my photo without permission


and what is their basis to sign such contracts?... access, network, and support, as was mentioned in my previous post... lets face it, no logically managed company will willingly pay money unless they really need to, as proven by all these "free" images harvested by the media companies from websites... and these fair dealing laws are not restricted to Singapore but are also present in some form or other amongst Common Law jurisdictions, which include quite a number of countries with influential media companies, like the US and the UK...
I think the basis of such a contract is that you don't need to send your own reporters and photographers to war zones, other countries etc to write some news coverage, so they just buy the news + pics from a newsagency.......

not exactly... the basis is "you don't need to send your own reporters and photographers to war zones, other countries etc to write some news coverage" (as you have mentioned), so they pay for the timely access to the news stories and images, and the network, and the support of the agencies, rather than the images and news stories themselves...

there's a lot of information here which may conflict with each other.

There are a few points to establish. Did you give the performer the photo

a)as a keepsake,

or did you

b) give him the photo as he had commissioned you to take photographs of him, and there is an agreement for such a transaction

if a), you still own the copyright, and the newspaper has infringed on your copyright. Their beef will be with the performer. Your beef is with the newspaper who had infringed your copyright

if b), the commissioning party owns the copyright.

As a photographer it is our responsibility to police for infringement of our copyrights as these are the lifeblood of our work.

Should you wish not to pursue it that is your choice, however it is good to understand that it doesn't mean that just because SPH used it you have no recourse.
