John 316

I have been patronising John 316 for the past few years. Though some things were more expensive, I still gave them business as they were quite friendly and responsive. In Oct 14, I placed a Nikon lens with John 316 to sell for me. They closed the shop this year without informing me, and took my lens away with him. When I queried the sale or whereabout of my lens, he would tell me someone placed a deposit, he don't know which box he put in his church or a rented storeroom. Eventually, he said he might have lost it so wanted to give me his Leica second-hand camera as compensation. I declined his camera and wanted monetary compensation. From then, he did not respond to my messages and answer my phone call. Anyone else has similar experience as mine?

Currently, Sam is operating under Camera Garage. Be careful and smart with your purchases.

Worst case, you may have to seek redress with the small claims tribunal. Any paperwork for the consignment?

Let's just say you are not the only one who Sam has owed money to. Good luck.

I'm been telling everyone in this forum abt that shop for years. I don't trust them at all, since the day I stepped in their shop.

Well, some forum members are blindly loyal to them

Make a police report. The lens should have a serial number.

This type of ppl may not even feel guilt.

Just treat that as tithes lo

For goodness sake, those giving good review for John 316 please take down your recommendation. When he is earning your money, everybody is sister or brother. Chase him for money. . You become nobody. If I file a case at small claim tribunal, Richard Gan will have to answer cos he is the sole proprietor. Pissed.

Criminal Breach of Trust as a merchant. Punishment may up to life sentence.

CBT carries an imprisonment of up to 7 years, not life sentence.

there is no need to bring religion into the thread especially when this is a complaint about a shop / person.

thread moved to consumers.

And to add lawyer's favourite phrase: It depends.
Depends on intention and several other factors.

Criminal breach of trust by public servant, or by banker, merchant, or agent

409. Whoever, being in any manner entrusted with property, or with any dominion over property, in his capacity of a public servant, or in the way of his business as a banker, a merchant, a factor, a broker, an attorney or an agent, commits criminal breach of trust in respect of that property, shall be punished with imprisonment for life, or with imprisonment for a term which may extend to 20 years, and shall also be liable to fine.

It is mostly likely dependent upon past similar cases' market rate too. Its probably few weeks or fine if its a light case.

I think if you make a police report he will response fast, nobody wants to go to jail for a lens, or get involved with the police, get a criminal record, or get his dad involved too.

got bad experience with this shop too..
about a year ago i waited 2-3hrs for a lens which they claim will reach but end up telling me that the supplier MIA.

Sam is still actively contactable or at least be brought into notice via fb page or at the Eng Hoon St physical store of the camera garage. I suggest TS contact him to resolve his issue. If not, file a police report and keep us updated.

I went to Eng Hoon Street once, it is a café called The Orange Thimble, Camera Garage does not have a physical store there. Sam only uses it to meet people.

HI, Just to give some updates on this. I had filed a police report but police replied no further action as there is no evidence (???). I went Small Claim Tribunal, but the case is thrown out as this is no sales of good, so they don't have power to hear. Lesson learnt, never ever put your things in any shops to sell on your behalf (even it comes with an acknowledgement slip), as you are not protected under consumers act if the person decided to run away with your things. Damn it.

This is unfortunate to hear TS. I bumped into him several times in Funan on weekdays afternoons so maybe you like to stake out there and confront him when you see him.

I heard other people who are in the same predicament as you. Maybe you all can contact each other and arrange to go make a police report together. One person making a report may have no effect but if more people come out and report against him together, I think the Police may have a valid reason to call him up for investigation.

I bet Sam is monitoring this thread closely. I highly suggest all people who are in the same situation as TS contact TS via PMs and arrange for the next course of action together in order to get your money back. The rest of us can spread the word as well. Good luck TS.
