Copyright issue


Same. That time, an online journal magazine asked my permission to use my photo as cover, I didn't even mentioned money, I simply asked them to credit me as the photographer and they were to happy to do that. :bsmilie:

Honesty is still the best policy =)
 

There is something we can all do to help:

1) TS should post on their public forum (their facebook page, website, etc) that they had leeched your photos
2) State it there clearly that they had used you photo without your knowing or permission and had thus breach your ownership of the image and infringe your copyright
3) Inform us here
4) The rest of CS can log on to their public forum page to support you.

That is the best way we can help support each other, by taking action.

That is a very good idea if they deny or kept quiet. Just to be fair to them, I shall still give them some time to response. The most is I can wait until this friday for either their email reply or facebook message reply. If nothing from them, I will post on their facebook (which I think they havent post anything since 3rd march) and make it big.

They finally replied. Their managing director asked if I would like them to take them down or provide acknowledgement to me?

He said the images were grabbed by one of their junior feature writers from Google Images, a practice which they no longer do today.

Its my first time encountering such things, any advise?

I'll definitely go with providing acknowledgement. It will be even better if that acknowledgement contains some sort of contact info like your email. This way your work continues to get exposure, and other publishers may approach you. All these are ultimately good for your photographic career.

Maybe someday you will be writing "I remember my first published photographs were on XXX and XXX websites. One of them did not even acknowledge me! But when they did, it opened the door for many more such opportunities."

You already rise the awareness of IP. compensation by the violator will always be case by case basis... no 3rd party can help.

With media so advance, many will know what cause of action to be taken if they feel they are violated.

Please Noted: I have nothing to do with the company watsoever. I just feel everyone need to know when to stop, be it good or bad.

Good- stop when is time, so that we do not become arrogant, too pride of ourself. Remember there is always some one better.
Bad- Who does make mistake, cross the wrong path. Show true gracefulness. Let live...

I think I will go with my initial decision, acknowledgement. To be fair to their managing director who replied me, he might not really have known that his writers took photos off the internet without the owner knowing. I just replied him, let they continue to use my photo but with clear acknowlegement to the flickr page where the photo originated from. I think you guys are right, who knows it might open the door to more opportunities.

The acknowledgements don't seem to be up yet. I've hoping to see if the other photographs get acknowledged too.

Ya, I am checking everyday, I was thinking of sending him an email again later. Was going to ask him if he really is sincere because have yet to see the acknowledgement... I did mentioned to him something about him getting into trouble because of copyright issue, lets see if he will acknowledge the others. The only thing I can do for the others is to warn him about the copyright issue on the other photos, as I don't know where the other photos were picked from, a bit hard to warn the owners...

Just did, I also feel its not right, so replied straight away. Wait the owner of those 3 other photos spot it, it might get me in trouble.

I hope they get it right now because I did said specifically only the 1st photo(left) and 4th is mine. When I saw just my name atat the end of that article, I knew I have to reply them immediately to correct the acknowledgement

It feels like they are only doing when being challenged and not because they should be morally/ethically obligated. Nice photos btw:)

Thanks :) Those are photos from my earlier days with my EPL1. I think I am improving more and more with each photos. :D

Anyway, I will keep on doing that until they put the acknowledgement nicely, if not, I rather they remove my photos because you are right, it feels like they are only doing it when being challenged. It will also be better if the owners of the other photos knows their photos were being used illegally, that way, at least can really make wake up and realized truthfully they have done wrong.
 

I have just been informed (after I email them again) that they decided not to use that page after I insisted they acknowledge just 2 photos instead of the whole page to me. Thieves are still thieves... With the unprofessional spirit they have, 1 day they are going to get into trouble and it's not my problem.
