Huge words DRAFT across the image and they market it anyway.

Regardless photographer or not, its a breach against content creators. We should not discriminate photographers vs not-photographers.

Of course. I pointed that out as this is the "Photo Biz" section after all, might not have been the best place to post it if the infringement was not against a photographer (not that it makes the infringement any less wrong).

Highly unlikely. The only time a marketeer would plaster draft across would be if it were a mockup to be shown to stakeholders.

Assuming you are right though, would it not make more sense to plaster the copyright owners' name or company's name over it?
