Have you seen the T&C section on IP Rights? Just by entering the competition you have to assign SMA all your IP rights on an EXCLUSIVE basis. Totally unreasonable.

14. Each participating team and each member thereto hereby agree and acknowledge that all copyright and other rights in the video clips/ materials submitted hereunder including the video and underlying works (the “Materials”) shall be assigned to SMA and are solely and exclusively owned by SMA. Each team and each member thereto shall sign such documents as may be required by SMA for these purposes. All entries will become the property of SMA and will not be returned. For the avoidance of doubt, each team and each member thereto hereby agree and acknowledge that SMA shall have the right to edit the Materials (or any part thereof) in any manner whatsoever in its sole and absolute discretion and shall have the right without limitation to publish, reproduce, display, distribute, make available to the public and otherwise use any and all the Materials in any manner that it deems fit. Each team member hereby expressly waives any moral rights which he/she may have or be entitled under any applicable legislation now existing or in the future enacted in any part of the world.
 

And you even have to pay them money for the priviledge of signing away your IP rights! I doubt if this is enforceable but I certainly would not want to take part.

It is good that you shared this, because I think many here are interested in such competitions. But the T&Cs for this particular one are out of order. Unless you happen to be responsible for the T&Cs, would not blame you lah. :)

Thanks for posting on this thread. If this situation can be improved it will be better for the small-but-growing creative video segment in Singapore. Below are some of my thoughts, for your consideration.

My wife and I have a video that we were interested in submitting, but the competition T&Cs would require us to sign over all rights in the video (including source materials) to SMA. Therefore we decided not to enter the competition. Apart from being unreasonable, this type of condition in the T&Cs is unnecessary.

It is correct for SMA to insist on having rights in the IP of the winning entries, that allow SMA to use the materials as they need, but there is no real reason to take away all the rights of the originator, especially the rights related to the source materials. Of course if the prize is large enough, everything is negotiable, but if SMA doesn't really need exclusive rights then there is no point paying for them.

And for non-winning entries, all that SMA maybe requires (in my opinion) is the right to use extracts from the videos for promotional purposes. I am sure most people entering would be happy to allow this (with appropriate credits), since they will also get publicity out of it. But there is no reason I can see for SMA to require the entrants to sign away all the rights in their own creations. And since SMA is not paying them anything at all (in fact SMA is demanding an entry fee for the competition), it is obviously unfair for SMA to insist on this.


Hopefully SMA will hold more competitions in future, with changes to the T&Cs that will attract even more entries.

In a way, this is the easiest and fastest way to gather footage for future projects imo. possibly the cheapest as well.
