Scratched Negatives

You all know about this disclaimer (or whatever you call it) at some corner of the paper bag that comes with your negs and photos that says: 'Every reasonable care will be taken with film negatives, etc. our liability, however, in case of accident damage or loss will be limited to replacement with similar unexposed film.'

Well, my negs are scratched so I went back to the lab to excercise my rights :D Mind you, I'm not being greedy, I'm just a informed/educated consumer :angel:

The scratches were across 4 frames, 1/3 into the roll, not very noticeable on the negs, but I can see it on the photos. The lady claims that if the machine is responsible for the scratches, then the entire roll would have been ruined, or that my camera is mouldy, which I think is quite impossible given that I just bought it for 3 months. So right now she has to check with her boss if they're liable.

So my question is, if the machine is responsible, would my situation occur, as in only a fine scratch across 4 frames??

And has anyone tried claiming like I did?? Thanks in advance for your replies

Yes, there is a possibility that the entire roll is not scratched, only a part of it. Otherwise, going by the same logic, if your camera's film gate has dust, mould, etc, it will also scratch the whole roll.

Mishandling during the printing stage can also cause these scratches that does not run the entire length of the film.
