Subject: Usage of train image

Foundation Communications is an advertising agency and we are looking to use the following image in a property brochure.

I'm not very knowledgeable on such stuff, I only know malt, barley & hops:bsmilie:.
So basically I can either deny or allow they to use the image right?

Just call and ask since they are local as well.

Find out if they are using it for Cover or inside. Cover cost more.
Please ask to be paid, they are making money from the brochure.
 

i typically ignore if they are asking for free and they are a commercial organization.

Gary, I think you need an agent...you have to aim higher than just beer!
BTW, agent fee is just a Fujifilm X100;p
 

Good job Gary! But looking at their email, I suggest you discuss with them on how much u wanna charge (if you want to charge). If its free, they better give u a good reason, and whats your mileage.

More importantly, bear in mind some areas, installations, equipment; buildings, and in this case; the company that owns the train may have some legislation, especially for commercial reasons. Dont want to get to the wrong side of the law.

let me dig out some note/documents for u tonight. May not bullet-proof u, but its up to u to decide after u see em. i will pm u my hp.
 

and btw, as amatuer, chasing money is always difficult.. big fish eats small fish..

Agree. Make sure there are no logos in sight or some copyright material. Ask for $200 if you want them to 'Bite' don't ask for too much or they will run. I know Pros out there will scoff at this pricing and I apologise in advance.
 

make it clear what they are looking for:

- rights to use the image
- exclusive rights to the image

sounds like the first, which will be a lot lower for sure. $200 is a good figure to ask for a hobbyist, i guess. just don't let them get away with it for free, that's my view.

seems like they are fishing for a freebie, which is always the case.. but there have been exceptions, of course. at least for me. so always give the benefit of the doubt first.. and if they are looking for it for free and claim that they will provide "credits" and give you greater exposure, to be honest you should tell them to go fly a kite, but i usually tell them very nicely that they should look at stock images to solve their problems if they have a limited budget. (which is a nice way of telling them to go fly a kite)

Yes, totally agrees with that. Gary you will definitely has the some limited rights as a photographer for that picture, but that is as far as it gets. Especially when the pictures is being used commercially, things are totally different. :sweat:

One good example is our nation's CBD skyline... many have taken pictures of it... but once it is being applied commercially, you will need to pay royalties, even you are the photographer.

:thumbsup: for no logo reminder, & $200 is a good deal. Stress that you are a leisure shooter, and for private collection, ask for cash, U can sign on their petty cash voucher but u will not issue receipt! dont give me that end of the month closing +30 days thingie.

Anyone got a clue on this one?

Anyway, the railway is not in an enclosed or restricted place even they belongs to the KTM. No one will sue you if you sell the images taken at those places. BTW, they got more things to worry about than to sue you.

That's why you should buy our PPAS handbook, you can make money form any of your images, you need to know how.

hahahahahaha! Back from Photokina???

Wa serious ah? Actually there is a no photography big sign at the BT Railway but after chatting to the station master for awhile, he was alright with us taking pictures

You totally nail it. If you are not selling a "product" by using the background subject aka the train then nothing wrong with it. You can even shoot a model in front of Fullerton Hotel and sell the picture to Gucci and Fullerton group cannot do anything. But of cause asking for permission is always safe. But if you shoot across the street then that's another story.
