Wah Hung Sheng, SMA's IPR conditions are still very stringent! Do you honestly think this is fair? Even applicants who don't win anything are expected to give up the rights to exploit their own materials? Why is that? And SMA want the right to use all the entries without compensation or even credit to the original creator. How come they need that?


Intellectual Property Rights
14.
By submitting an original video entry and entering the Competition, each Entrant grants the Organizers the right in perpetuity to publish, edit, adapt, modify, reproduce, display, distribute, make available to the public and/or otherwise use the video clips/ materials submitted hereunder including the video and underlying works (the “Materials”), in any manner for any and all purposes without limitation (including but not limited to advertisements, publicity and/or marketing), in any and all media worldwide without further compensation to or permission from Entrant, and with or without credit to Entrant, at the Organizers’ sole discretion.
15.
Each Entrant hereby expressly waives any moral rights which he/she may have or be entitled under any applicable legislation now existing or in the future enacted in any part of the world. Each Entrant agrees and acknowledges that the Organizers shall have no obligation to return any entries or provide explanations as to why an entry was disqualified. Each Entrant agrees that the Organizers shall not be under any obligation to exploit, publish, distribute and/or exhibit any video(s) and no Entrant shall have any claim against the Organizersin this regard. Each Entrant agrees that he/she will not exploit, or allow others to exploit, any of the Materials without obtaining the prior written approval of the Organizers.
 

This is as if we are giving you our videos. Why are there clauses like

" Each Entrant hereby expressly waives any moral rights which he/she may have or be entitled under any applicable legislation now existing or in the future enacted in any part of the world. "

I mean, it's a competition to showcase our videos. I understand if the content is used for advertising or other purposes related to highlighting or promoting the event. At least state your intentions and not just list everything as "at the Organizers’ sole discretion".

I don't mean to be sarcastic, but this is really creative. Seriously, I think we can all do better.
 

Hi guys, thank you for the feedback. I understand that the clauses of the Intellectual Property Rights may seem intimidating, but the intention is really not to be unfair to all the participants. In fact, learning from last year's feedback, SMA has removed the some of the clauses to ensure the participants' rights are being protected.

This year, SMA is trying our best to provide as many platforms as possible for all participants to showcase their video entries. These includes the televised programme on Ch5, an international short film festival, a local film festival and also some selected new media platforms for viewers to view and vote. SMA is in the midst of firming up the details, and more information will be announced later. Whether the video entries win the CVA awards or not, SMA's intention is to try our best to help most of the partcipants to gain more eye balls and the necessary exposure to raise your profile.

Such collaborations usually require SMA to have the rights to the videos and of course, we will seek the participants' consent for any of such showcasing.

Nevertheless, if this remains as a major concerns for most people, SMA will re-look into the clauses subsequently.

The prize money is way too low for that kind of IP clauses.

With a clause like this SMA and its Parent Body, MediaCorp, can take the concept of one of the entries and "reproduce" to a Feature Film and get high returns!

And the prize money is $30K in total, not individual prize of $30K, the ADs are kind of misleading.

not a personal attack but i think u should feedback this to your team. SMA of all institutions should realise that IP is every filmmakers biggest asset

Great way to source for ideas for new dramas :)
Then again they'll prob use same old formulas
